NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by Genesee County.

REQUEST FOR RELEASE OF FUNDS

On or after September 21, 2025, Genesee County will submit a request to the U.S. Department of Housing and Urban Development (HUD) for the release of 2024 Community Project Funds under Title I of the Housing and Community Development Act of 1974, as amended, to undertake projects known as:

Otterburn Park, 6162 Bristol Rd, Swartz Creek, MI 48473- ($290,000 of the Michigan Natural Resource Trust Fund and $283,333.33 of Community Project Funding)  The project is intended to support an existing 18-hole disc golf course, sled hill, existing gravel parking area, and non-motorized pathway along Bristol Road.    The improvements associated with this project include:  * 25-foot by 40-foot pre-manufactured pavilion and concrete slab.  * Pre-manufactured accessible restrooms (one to two stalls) and sanitary/water connections.   * 3,500 linear foot aggregate perimeter path, 8-foot wide.  * Paved Americans with Disabilities Act (ADA) parking spaces at existing gravel parking lot.  * Portable restroom concrete pad in the middle of the disc golf course.  * Canopy trees/native landscape  * Bike fix station on a concrete pad with shade structure.  * ADA picnic tables and trash/recycle bins.  * Entry gate

Creasy Bicentennial Park, 1505 E Grand Blanc Rd, Grand Blanc Township, MI 48439- ($500,000 of Michigan Department of Natural Resource Land and Water Conservation Funding and $283,000 of Community Project Funding)    The improvements associated with the LWCF grant include the following:  * Reconfigure Parking Lot B, adding seven paved Americans with Disabilities Act (ADA) spaces and associated storm sewer.  * Paved eight-foot accessible path from parking lot ADA spaces and new pavilions.  * Electrical service from South Pavilion to the Pond View Pavilion with various outlets along the route.  * South Pavilion improvements including a new concrete floor, steel counters in kitchen, ceiling tiles, lighting and paint in restrooms, conversion of storage room to an accessible family bathroom with adult changing table.    The improvements associated with the HUD grant include the following:  * Reconfigure Parking Lot A, adding ADA spaces and associated storm sewer.  * If budget allows improvements to the splash pad (Not part of this project).  The site drainage is in the Sherwood Drain district. The Sherwood Drain traverses the park along the westerly side of the site. We have included costs for anticipated storm water design, plan, and permitting for this project as well as anticipating future needs based on paving the entry drive.  No wetland impacts or clearing is needed for improvements.

Mundy Miracle Commons, 1286 W Hill Rd, Flint, MI 48507 Mundy Township- (Michigan Natural Resources Trust Fund and Community Project Funding)    The current project involves a universally accessible ”signature” playground and pavilion, This work will be funded by Michigan Natural Resources Trust Fund (MNRTF) grant funding. This work involves minor clearing, grading and foundations 42” in depth.    The HUD funding is applied to the pathway connection proposed west of the Miracle Field along an existing gravel access drive. This work impacts surface grading and does not include any clearing.    An amphitheater project is also proposed east of the sledding hill, directly north of the existing stormwater management basin. No clearing is involved, minor grading will be needed. It is a slab on grade, no foundations. A future Lighthouse recreation building, ballfield complex, access road and stormwater improvements are planned as funding allows.

FINDING OF NO SIGNIFICANT IMPACT

Genesee County has determined that these projects will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the Genesee County Community Development Program, Suite 8D, 324 South Saginaw St, Flint, MI 48502 and may be examined or copied weekdays 8 A.M to 12 P.M. and 1 P.M. to 5 P.M.

PUBLIC COMMENTS

Any individual, group, or agency may submit written comments on the ERR to Genesee County at the address above or to [email protected].  All comments received by September 21, 2025, will be considered by Genesee County prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.

RELEASE OF FUNDS

Genesee County certifies to HUD that Genesee County and Delrico J. Loyd, in his capacity as Chairperson of the Board of County Commissioners, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows Genesee County to use Program funds.

OBJECTIONS TO RELEASE OF FUNDS

HUD will accept objections to its release of funds and Genesee County’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of Genesee County; (b) Genesee County has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to the U. S. Department of Housing and Urban Development –Detroit Field Office, Keith E. Potential objectors should contact HUD to verify the actual last day of the objection period.
