NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by Genesee County.

REQUEST FOR RELEASE OF FUNDS

On or after July 19, 2025, Genesee County will submit a request to the U.S. Department of Housing and Urban Development (HUD) for the release of Community Development Block Grant Program (CDBG) funds and Home Investment Partnerships Program (HOME) funds under Title I of the Housing and Community Development Act of 1974, as amended, to undertake projects known as:

City of Burton- 2025 Infrastructure Improvements ($201,442 of CDBG Funds)

Buder from Saginaw to Morrison and Homestead from Parkwood to Boatfield are existing gravel streets. The scope of the work will consist of reshaping the existing street, ditching as necessary, removal and repair of driveways as necessary, updating of signage, providing proper drainage, and paving the street.

 

City of Montrose- 2025 Infrastructure Improvements ($26,263 of CDBG Funds)

The project would involve installing needed sidewalk in the low to moderate income areas of the City to include East Oak St, Perry St, and Ash St. This includes removing and replacing broken, nonexistent ADA compliant sidewalk in the identified project location. This would also include installation of ramps and detectable ramp surfacing, grinding between sidewalk squares where heaving is identified and removal and replacement of sidewalks where needed. 36 inches wide, depth of 6-8 inches.

 

City of Swartz Creek- 2025 Infrastructure Improvements ($24,633 of CDBG Funds)

The city intends to construct an accessible drop off ramp and entrance to the Pajtas Amphitheater in downtown Swartz Creek. The current asphalt pad is forty years old and does not provide improved surface access to the concert viewing area. New concrete is proposed to replace the existing asphalt, with the tree remaining, and to extend a concrete pad at grade into the band shell viewing area. The concrete area is expected to be about 2,500 square feet and may need to be 6 inches thick in order to accommodate a potential traffic drop off/turn around.

 

2025 Genesee County CDBG Home Improvement Program (HIP) ($581,580 of CDBG Funds)- The program provides emergency home repair assistance to eligible owner-occupied single-family homeowners through deferred payment loans throughout Genesee County except non-participating municipalities including the Cities of Clio and Flint, and the Villages of Lennon and Otter Lake. The funds will assist low to moderate-income homeowners with home improvements including roofing, window, furnaces, wells, electrical, and plumbing repairs.

FINDING OF NO SIGNIFICANT IMPACT

Genesee County has determined that these projects will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the Genesee County Community Development Program, 1101 Beach Street, Room 111, Flint, MI 48502 and may be examined or copied weekdays 8 A.M to 12 P.M. and 1 P.M. to 5 P.M.

PUBLIC COMMENTS

Any individual, group, or agency may submit written comments on the ERR to Genesee County at the address above or to [email protected].  All comments received by July 19, 2025, will be considered by Genesee County prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.

RELEASE OF FUNDS

Genesee County certifies to HUD that Genesee County and Delrico J. Loyd, in his capacity as Chairperson of the Board of County Commissioners, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows Genesee County to use Program funds.

OBJECTIONS TO RELEASE OF FUNDS

HUD will accept objections to its release of funds and Genesee County’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of Genesee County; (b) Genesee County has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to the U. S. Department of Housing and Urban Development –Detroit Field Office, Keith E. Potential objectors should contact HUD to verify the actual last day of the objection period.
