These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by Genesee County.
REQUEST FOR RELEASE OF FUNDS
On or after October 4, 2022, Genesee County will submit a request to the U.S. Department of Housing and Urban Development (HUD) for the release of Home Investment Partnerships Program (HOME) funds under Title I of the Housing and Community Development Act of 1974, as amended, to undertake projects known as:
1. 2021 Communities First Inc Multi-Family New Construction ($1,000,000 of HOME Funds) – The project proposes to construct a mixed-use (residential and supportive service) development for individuals and families and will involve redeveloping a vacant lot. The name of this development is Orchard Grove, and the address is 2765 Flushing Rd, Flint, MI 48504. The proposed project will include a total of 40 mixed-income rental housing units as well as 5,297 square feet of space related to on-site supportive services. The total square footage for the building will be 51,667 square feet and will be 176’ 8” long by 124’ 6” wide on the west of the building and 62’ 10” wide on the east end. Seven of the units are proposed to use Genesee County HOME funding to assist low-income individuals and families.
This project is taking place in coordination with the construction of a separate mixed-use (residential and supportive service) development on the same site as Orchard Grove. This development is called Orchard Manor and includes two buildings. The address for this development is 2485 Flushing Rd, Flint, MI 48504. One building is proposed to be apartments, and the other townhomes. The total Orchard Manor development consists of 34 mixed-income rental housing units serving individuals and families in Flint, MI. Total square footage of the Orchard Manor development is 35,451 square feet. No county funds are being used on this proposed development.
Total area of the site will be about 300’ by 390’ for a total square footage of approximately 117,000 square feet. This includes up to 128 parking spaces (89 for Orchard Grove and 39 for Orchard Manor. The total acreage for the entire site is 3.215 acres.

FINDING OF NO SIGNIFICANT IMPACT
Genesee County has determined that the projects will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the Genesee County Community Development Program, 1101 Beach Street, Room 111, Flint, MI 48502 and may be examined or copied weekdays 8 A.M to 12 P.M. and 1 P.M. to 5 P.M.
PUBLIC COMMENTS
Any individual, group, or agency may submit written comments on the ERR to Genesee County at the address above or to [email protected]. All comments received by October 3, 2022, will be considered by Genesee County prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.
RELEASE OF FUNDS
Genesee County certifies to HUD that Genesee County and Domonique Clemons, in his capacity as Chairperson of the Board of County Commissioners, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows Genesee County to use Program funds.
OBJECTIONS TO RELEASE OF FUNDS
HUD will accept objections to its release of funds and Genesee County’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of Genesee County; (b) Genesee County has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed by email to [email protected]. Potential objectors should contact HUD to verify the actual last day of the objection period.
